The rules are more strict for Shinigami, a human has to surrender the notebook or die to lose it, but Shinigami are not allowed to even lose it. That's why Light saw Ryuk when he got the notebook, but couldn't see Rem, because that book already belonged to Ryuk the moment he got it from another Shinigami.
